By using the Auto Porto platform you agree to the following terms. Please read them carefully before placing any order.
Platform Overview
What Auto Porto is and what it does
Auto Porto is an online marketplace that enables professional sellers to list and sell new and used automotive parts, as well as vehicles — including damaged and accident vehicles — to buyers worldwide.
The platform is accessible at auto-porto.ovh and is operated by Auto Porto, a company registered in Portugal. Auto Porto acts as a technical intermediary and is not itself the seller of goods listed by third-party sellers, except where explicitly stated.

Role of the Platform
Auto Porto as technical intermediary
Auto Porto's role is limited to providing the technical infrastructure for buyers and sellers to connect, transact and communicate. The purchase contract for any product is formed directly between the buyer and the seller.
Auto Porto reserves the right to remove any listing that does not comply with its seller policies, applicable law, or product safety regulations.
Account & Registration
Your responsibilities as a registered user
Creating an account is free and gives you access to order tracking, wishlists, saved addresses and other personalised features. By registering you agree to:
- Provide accurate, complete and up-to-date personal information.
- Keep your login credentials strictly confidential.
- Be solely responsible for all activity that takes place under your account.
- Notify Auto Porto immediately of any unauthorised use of your account.
- Not create multiple accounts or impersonate any other person or entity.
Auto Porto reserves the right to suspend or permanently close accounts that violate these obligations or that are found to be involved in fraudulent activity.
Products & Listings
Accuracy, availability and seller responsibility
All product listings on Auto Porto are created and managed by the sellers. Descriptions, prices, photos, compatibility references and stock availability are the sole responsibility of the seller who published them.
Auto Porto does not guarantee the accuracy or completeness of any listing, but commits to taking prompt action — including removal — upon receipt of a valid notice of non-compliant, misleading or dangerous content.
- Prices shown include VAT where applicable and are set by each seller individually.
- Product images are indicative — refer to the part reference number for compatibility.
- Stock availability is updated in real time but may vary due to concurrent orders.
- Sellers must comply with EU Regulation 2023/988 on general product safety.
Orders
How orders are placed and confirmed
Placing an order on Auto Porto creates a binding purchase contract between you (the buyer) and the relevant seller. Auto Porto is not a party to this contract.
An order is confirmed when:
- You have completed the checkout process and payment has been successfully authorised.
- You have received an order confirmation email from Auto Porto on behalf of the seller.
- The seller has not cancelled the order due to stock unavailability within 24 hours.
Auto Porto reserves the right to cancel any order where payment fraud is suspected or where the listing contained a manifest pricing error.
Payment
Accepted methods and secure processing
Payments are processed through secure, PCI-DSS compliant third-party providers (including Stripe). Auto Porto does not store or have access to your full payment card details.
- Accepted methods: Visa, Mastercard, PayPal, bank transfer and cash on delivery (where available).
- All transactions are SSL-encrypted during transmission.
- A platform service fee may be applied on certain transactions and will be shown at checkout.
- In case of a failed payment, your order will not be confirmed and you will be notified immediately.
Delivery
Shipping, timelines and responsibility
Products are dispatched by the seller or their appointed logistics partners. Estimated delivery timelines and shipping costs are displayed at the time of order and vary by seller, destination and carrier.
- Delivery times are estimates and not guarantees — delays may occur due to carrier or customs issues.
- Risk of loss or damage passes to the buyer upon delivery to the specified address.
- If your order does not arrive within the stated window, contact the seller via your account.
- Auto Porto is not liable for delays attributable to third-party carriers or force majeure events.
Right of Withdrawal
Your 14-day cooling-off period
To exercise this right, notify the seller through your account or contact contact@auto-porto.com before the 14-day period expires. Following notification, you have a further 14 days to return the item.
The following products are excluded from the right of withdrawal:
- Parts that have been installed, modified or used after receipt.
- Custom-made or specially ordered items produced to the buyer's specification.
- Sealed items that have been opened and cannot be resold for health or safety reasons.
- Vehicles (subject to a separate sale agreement between buyer and seller).
Returns
Process and conditions for returning goods
Return conditions are set by each seller and displayed on their listing pages. In all cases, returned products must be in their original, uninstalled condition and include all original packaging, accessories and documentation.

Liability
What Auto Porto is and is not responsible for
Sellers are solely responsible for the compliance, quality, safety and accurate description of the products they list. Auto Porto is not a party to the sale contract and cannot be held liable for:
- The quality, safety, fitness for purpose or legality of products sold by third-party sellers.
- Disputes, losses or damages arising directly between buyers and sellers.
- Technical interruptions, outages or data loss beyond Auto Porto's reasonable control.
- The content of external websites linked from the platform.
Auto Porto commits to acting promptly upon receipt of any valid complaint regarding dangerous or non-compliant products, including removal of the listing and, where necessary, notification of the relevant authorities.
Regulatory Compliance
Seller obligations under EU law
All sellers registered on Auto Porto must comply with the following:
- EU Regulation 2023/988 on general product safety — all products must be safe for their intended use.
- Applicable VAT registration and reporting obligations in the seller's country and countries of sale.
- EU consumer protection legislation, including distance selling and warranty rules.
- GDPR and applicable data protection laws when handling buyer data.
Auto Porto reserves the right to suspend or permanently ban any seller account found to be in breach of these requirements.
Personal Data
How your data is used
Personal data collected through the Auto Porto platform is processed in accordance with our Privacy Policy and applicable data protection legislation, including the GDPR.
By creating an account or placing an order, you consent to the processing of your personal data as described in the Privacy Policy. You may withdraw consent or exercise your GDPR rights at any time by contacting contact@auto-porto.com.
Disputes
Resolving problems between buyers and sellers
In the event of a dispute arising from a transaction, buyers and sellers are encouraged to resolve the matter directly through the platform messaging system.
If a satisfactory resolution cannot be reached within 7 business days, Auto Porto may intervene as a neutral facilitator. Unresolved disputes may be referred to:
- Competent national consumer protection authorities.
- The EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
- The competent courts of Portugal as the governing jurisdiction.
Intellectual Property
Ownership of platform content and design
All content on the Auto Porto platform — including the name, logo, graphic design, layout, source code, texts, photographs and product data curated by Auto Porto — is the exclusive property of Auto Porto or its licensed content providers, and is protected by copyright and intellectual property law.
- You may not copy, reproduce, republish, upload, post or transmit any content without prior written authorisation.
- Sellers retain ownership of their own product images and descriptions but grant Auto Porto a licence to display them on the platform.
- Any unauthorised use may result in legal proceedings.
Amendments
How and when these terms may change
Auto Porto reserves the right to modify these Terms of Use at any time. Where changes are material, users will be notified by email or via a notice on the platform at least 14 days before they take effect.
Continued use of the platform after the effective date of any change constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the platform and may close your account at any time.
Governing Law
Jurisdiction and applicable legislation
These Terms of Use are governed by European Union law and, in all matters not covered by EU law, by the law of Portugal.
Any dispute relating to these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent Portuguese courts, without prejudice to any mandatory consumer protection provisions applicable in the buyer's country of habitual residence.
