The director of publication of the website auto-porto.ovh is the legal representative of Auto Porto. This person is responsible for the content published on the platform by Auto Porto itself, distinct from content published by third-party sellers.

The Auto Porto platform is hosted on servers operated by a third-party cloud infrastructure provider. The platform is built on Odoo, an open-source ERP and e-commerce framework licensed under the LGPL.

Auto Porto operates as an online marketplace and technical intermediary. The platform enables professional sellers to list and sell:

• New and used automotive spare parts and accessories.
• New, used and certified vehicles.
• Damaged and accident vehicles for repair or salvage.

Auto Porto does not own the products listed by third-party sellers and is not a party to purchase contracts formed between buyers and sellers on the platform. Certain products may be sold directly by Auto Porto where explicitly indicated.

All sellers registered on the Auto Porto marketplace are professional traders subject to the following obligations:

• Valid business registration and active status in their country of establishment.
• Sole responsibility for the accuracy, legality, safety and quality of all listings.
• Compliance with EU Regulation 2023/988 on general product safety.
• Compliance with applicable VAT registration and reporting obligations.
• Respect of consumer protection law, including distance selling and warranty rules.
• Adherence to the Seller Contract accepted at registration — available on request.

Auto Porto reserves the right to suspend or permanently remove any seller account found to be in breach of these requirements or of Auto Porto's platform policies.

The Auto Porto name, logo, graphic design, layout, source code, interface elements, texts and all content produced by Auto Porto are the exclusive property of Auto Porto or their respective rights holders, and are protected by intellectual property and copyright law.

• Any reproduction, representation, modification or distribution of platform content is prohibited without prior written authorisation from Auto Porto.
• Sellers retain ownership of their own product images, descriptions and brand elements, but grant Auto Porto a non-exclusive, royalty-free licence to display them on the platform.
• Third-party brand names and logos displayed in listings are the property of their respective owners and are used solely for product identification purposes.

As a technical intermediary, Auto Porto cannot be held liable for:

• The quality, safety, fitness for purpose or legal compliance of products listed by third-party sellers.
• Disputes, losses or damages arising directly between buyers and sellers.
• Errors, inaccuracies or omissions in product listings created by sellers.
• Technical interruptions, outages, data loss or platform unavailability beyond our reasonable control.
• The content of external websites linked from the platform.

Auto Porto commits to acting promptly upon receipt of any valid notice of non-compliant, misleading or dangerous content — including removing the listing and, where required, notifying the competent authorities.

Personal data collected through this website is processed by Auto Porto as data controller in accordance with the General Data Protection Regulation (GDPR — EU 2016/679) and applicable national data protection law.
